CLOSING OVER THE FESTIVE SEASON?

If you haven’t already done so, now is the time to start talking to your staff about leave plans for the festive closedown, if your business traditionally shuts down over the festive season. Under employment law:

  • An employer can only have one annual closedown a year; and
  • During this closedown period, an employer can direct the employee to take leave even if it means some or all of the leave is unpaid; and
  • An employer must give at least 14 days’ notice of the closedown.

CHRISTMAS & NEW YEAR ARE WEEKEND EVENTS …..

And this means that special rules apply – the Mondayisation of the public holidays. We’ve done the mahi (work) for you and included a simple table (below) for you to use as a guide.

** If your employee doesn’t usually work a Monday, there is no entitlement to a public holiday and it’s the same for the Tuesday.
